Understanding the Probate process in Idaho 🧐⁣⁣ ⁣⁣ 1) When is Probate required? A Probate is required in Idaho any time an estate has a value of $100k or more, and/or if that estate holds any real property (i.e. your home, rental property, etc.). 𝘐𝘮𝘱𝘰𝘳𝘵𝘢𝘯𝘵 𝘯𝘰𝘵𝘦 - 𝘫𝘶𝘴𝘵 𝘣𝘦𝘤𝘢𝘶𝘴𝘦 𝘐𝘥𝘢𝘩𝘰 𝘪𝘴 𝘢 𝘤𝘰𝘮𝘮𝘶𝘯𝘪𝘵𝘺 𝘱𝘳𝘰𝘱𝘦𝘳𝘵𝘺 𝘴𝘵𝘢𝘵𝘦 𝘥𝘰𝘦𝘴 𝘕𝘖𝘛 𝘮𝘦𝘢𝘯 𝘵𝘩𝘢𝘵 𝘺𝘰𝘶 𝘢𝘷𝘰𝘪𝘥 𝘗𝘳𝘰𝘣𝘢𝘵𝘦 𝘸𝘩𝘦𝘯 𝘺𝘰𝘶𝘳 𝘴𝘱𝘰𝘶𝘴𝘦 𝘱𝘢𝘴𝘴𝘦𝘴 𝘢𝘸𝘢𝘺. ⁣⁣ ⁣⁣ 2) What happens during a Probate? There are essentially six steps in the process:⁣⁣ ✔️ A petition for Probate and for appointment of a Personal Representative (PR) is filed with the court;⁣⁣ ✔️ The court enters the order for the PR and determines if there is a valid Last Will and Testament or if the preceding will be under the laws of intestacy;⁣⁣ ✔️ Notice to potential creditors is published in the newspaper;⁣⁣ ✔️ An inventory of property owned by decedent at time of death is filed;⁣⁣ ✔️ Distributions are made by the PR pursuant to the Will or under intestacy laws;⁣⁣ ✔️ PR files a statement with the court to close the estate. ⁣⁣ ⁣⁣ 3) How long does the Probate process take in Idaho? Typically at least 6 months (Idaho statutes require the estate to remain open at least this long so that potential creditors have a chance to come forward). Depending on the type of property in the estate and any potential beneficiary complications, the process can last even longer. ⁣⁣ The timing to finish the Probate process is one of the reasons many folks opt for a Revocable Living Trust for their estate plan. ⁣⁣ Questions? What is a “Living Will” and how is it different than your Last Will and Testament?⁣ ⁣ A Living Will is a document that allows you to specify your wishes regarding end of life care. For a Living Will to become binding, your doctor will have to find that 3 criteria are met: 1) you have a terminal condition (𝘪𝘦 𝘵𝘩𝘦𝘳𝘦 𝘪𝘴 𝘯𝘰 𝘩𝘰𝘱𝘦 𝘰f 𝘳𝘦𝘤𝘰𝘷𝘦𝘳𝘺); 2) your death is imminent (𝘵𝘩𝘦 𝘵𝘦𝘳𝘮𝘪𝘯𝘢𝘭 𝘤𝘰𝘯𝘥𝘪𝘵𝘪𝘰𝘯 𝘸𝘪𝘭𝘭 𝘭𝘦𝘢𝘥 𝘵𝘰 𝘺𝘰𝘶𝘳 𝘥𝘦𝘢𝘵𝘩 𝘶𝘯𝘭𝘦𝘴𝘴 𝘺𝘰𝘶 𝘢𝘳𝘦 𝘱𝘶𝘵 𝘰𝘯 𝘭𝘪𝘧𝘦 𝘴𝘶𝘱𝘱𝘰𝘳𝘵); 3) you are personally unable to communicate with your doctor about your wishes. ⁣ ⁣ If these 3 criteria are met, your doctor will look to your Living Will to determine how 𝐲𝐨𝐮 have previously directed him/her to proceed. This document allows you to be in the driver’s seat for important end of life decisions. ⁣ ⁣ Your Last Will and Testament on the other hand allows you to make decisions regarding distribution of your assets, guardianship of your minor children, protection of your loved ones and legacy, etc. ⁣ ⁣ While the documents have similar names, they serve very different purposes! I am a millennial, why do I need to worry about estate planning? ✨ Regardless of age, the most important reason to focus on estate planning is to provide for your loved ones once you are gone. Do you have minor children (in Idaho a minor is anyone under the age of 18) 👦🏼👶🏼? By completing an estate plan you have the ability to name the individuals you want to act as guardians for your children if for some reason you are unable to fill that role. ✨ Even though you are young and healthy, what if something happens and you become incapacitated and unable to care for yourself? If you do not have a completed estate plan, the court will be forced to step in and make a decision about who your legal guardian should be - who will make all decisions regarding your finances, property, assets, etc. on your behalf. As part of a basic estate plan you should have a durable power of attorney and a power of attorney for health care in place - these documents give you the ability to name who you want to take care of your daily affairs on your behalf. ✨ Digital assets are another important reason for millennials to put together estate plans. Digital assets include email accounts, social media accounts, digital currency and all sorts of digital payment methods. Idaho has specific statutes that allow personal representatives, trustees and fiduciaries to handle these digital assets, but that person must be listed in your estate plan in order to take advantage of these statues and gain access to your digital assets. ✨ Do you have questions about getting your estate plan in order? What is a Special Needs Trusts? 1) The specific goal of a Special Needs Trust is to provide protected benefits to a person (often your child, but could apply to sibling, parent, spouse, etc.) who has disabilities (physical, emotional or mental). The trust is created to provide protection to assets so that they can be distributed WHEN NEEDED well into the future. 2) The trust creates a protected plan of distribution - the goal is to allow the trustee to make distributions to the beneficiary of the trust, without causing the loss of disability benefits from a state or federal government agency. 3) Special Needs Trusts do not require court supervision. 3 Things to Consider Regarding Your Estate Plan if Your Spouse has Passed Away: 1) Does your last will and testament still accomplish what you want? Was your spouse listed as the primary beneficiary of your estate - that is, the person designated to receive all the assets, property and money from your estate? You should now consider who should be named as the primary beneficiary/beneficiaries of your estate. Was your spouse also set as your personal representative? Take a look at your appointments and make sure that your estate plan has the correct individuals in each role. . . . 2) Review your power of attorney documents and see if any changes need to be made to the individuals listed - are the individuals listed after your spouse willing and able to serve as your power of attorney? (Reminder: your personal representative listed in your Will makes sure that your estate is wrapped up according to your wishes, but the individual serving as your power of attorney helps to make decisions on your behalf while you are still living but incapacitated - the goal is to help you to avoid the time and expense associated with who should be named as your guardian if necessary). . . . 3) Think about your minor children. Who should now be named as a guardian for minor children? Do you need/want to make any changes to how property, assets and money from your estate would flow to your minor children if something were to happen to you? . . . Questions? 3 Things to Note Regarding Your Estate Plan and Your Assets/Debts: 1) What are your assets? At the time of your death, your Personal Representative (“PR”) will need to make a determination regarding all of your assets (including real property, vehicles, bank accounts, personal property, etc.) - so help your PR out and be organized! Keep a simple binder that includes an itemized list of the property you own and relevant documents (such as account statements). 2) What are your debts? Include a section in your binder that details any major items of debt your might have - including mortgages, loans for vehicles, account information for credit cards or home equity loans, etc. 3) Who pays your debts after you pass away? Idaho law requires that your verifiable debts be paid from your estate PRIOR to any distributions being made to beneficiaries. If you can keep simple asset/debt records organized with your other estate planning documents, you will help out your PR and ensure that your estate will pass per your wishes to your beneficiaries as soon as possible! . . .
